The Appeals Commission is an independent tribunal that reviews decisions made by the DRDRB.
The first step in the appeal process is to request a review of the decision by the original WCB decision-maker (Adjudicator or Case Manager). This requires submitting a formal letter explaining why the decision should be changed, based on WCB policies and the Workers’ Compensation Act.
This is the first formal level of review within WCB. The DRDRB is an internal, independent review panel.

WCB Customer Service typically responds within five (5) business days.
If the decision remains unchanged, a WCB Supervisor will conduct a second review.
The Supervisor may uphold, change, or further investigate the decision. A letter outlining the result will be sent to you.
1. Prepare a letter for submission to customer service and discuss the reason there is disagreement with the decision within 1-year of the decision date.
2. Receive a response from WCB, usually within 5 business days
3. Should the decision disagreement not be resolved, request that the appeal move forward to the DRDRB within 1 -year of the decision date.
4. Wait for a DRDRB hearing date (oral hearing), or submission deadline (documentary review)
5. Gather evidence for DRDRB proceedings
6. Prepare a written submission and/or an oral argument
7. Follow-up with the client regarding the submission
8. Confirm any outstanding details and prepare materials
9. Make written submissions or attend oral hearing
10. If the decision disagreement is still not resolved, submit a notice of appeal to the Appeals Commission within 1-year of the DRDRB decision.
11. Identify participants, representatives and witnesses.
12. Complete respective privacy agreements
13. Wait for a written submission deadline or hearing date.
14. Receive an Appeals Document Package – approximately 60 days before the hearing date or submission deadline
15. Submit additional evidence for the panel and respondent
16. Prepare a written submission and/or an oral argument
17. Follow-up with the client regarding the submission
18. Confirm any outstanding details and prepare materials
19. Provide the written submission or attend the oral hearing.
20. Receive a decision letter within 6-8 weeks.
